1. Acceptance of Terms

By accessing or using any Zapid AI product or service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use our services.

2. Description of Service

Zapid AI is a product studio, operated as a sole proprietorship by Atul Jain, that builds AI-powered applications for everyday life, including but not limited to tools for travel planning, health assistance, news summarisation, and entertainment. In these Terms, “Zapid AI”, “we”, “us”, and “our” refer to Atul Jain trading as Zapid AI. Our products are powered by large language models and agentic AI systems. Services are provided on an “as available” basis and are subject to change.

3. User Responsibilities

By using our services, you agree to:

• Provide accurate information when registering or joining the waitlist
• Use our services only for lawful purposes
• Not attempt to reverse-engineer, scrape, or misuse our AI systems
• Not use our services to generate harmful, illegal, or misleading content
• Maintain the security of your account credentials

4. AI-Generated Content

Our products use artificial intelligence to generate responses, recommendations, and content, and some products use agentic AI that can take actions on your behalf — such as drafting or sending messages, summarising your inbox, or performing tasks you configure. While we strive for accuracy, AI-generated content may contain errors, omissions, or outdated information.

Content from our health, travel, finance, and similar products is for informational purposes only and does not constitute professional medical, legal, or financial advice. Always consult a qualified professional for important decisions.

Where a product acts on your behalf, it does so based on the permissions and instructions you provide. You remain responsible for reviewing and authorising consequential actions, and for the accounts and services you connect. To the extent permitted by law, we are not liable for the outcomes of actions you have authorised an agentic feature to perform.

5. Intellectual Property

All content, branding, software, and technology on our platform is the intellectual property of Zapid AI unless otherwise stated. You may not copy, reproduce, distribute, or create derivative works from our platform without express written permission. Output generated by our AI tools for your personal use remains yours, subject to applicable terms of the underlying AI models.

6. Limitation of Liability

To the maximum extent permitted by law, Zapid AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total aggregate liability in connection with any claim shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) INR 1,000.

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded or limited under applicable Indian law, including liability for fraud or for death or personal injury caused by proven negligence.

7. Disclaimers

Our services are provided “as is” and “as available” without any warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or harmful components.

Nothing in these Terms affects any statutory rights you have as a consumer under applicable Indian law, including the Consumer Protection Act, 2019, which cannot be waived or limited by contract.

8. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, if we believe you have violated these terms or are using our services in a way that could harm us, other users, or third parties. You may also terminate your use of our services at any time.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause below, the courts at Gautam Buddh Nagar (Noida) shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force.

10. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, that cannot be resolved amicably within thirty (30) days shall be finally resolved by arbitration conducted by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Gautam Buddh Nagar (Noida), and the language shall be English. The arbitrator’s decision shall be final and binding. Nothing in this clause prevents either party from seeking urgent interim relief from a court of competent jurisdiction.

11. Changes to Terms

We may revise these Terms from time to time. We will post the updated Terms on this page with a new “Last updated” date, and where we hold your email and the change is material, we will make reasonable efforts to notify you. Continued use of our services after changes become effective constitutes acceptance of the revised Terms.
